Terms of use
Last updated 24 October 2026
The rules for using Secret Santa, in plain words: run your exchanges kindly, add only people who’d expect to hear from you, and buy gifts from the shops themselves.
About these terms
These terms are an agreement between you and Giftnote Online Pty Ltd ACN 655 779 829 (“Giftnote”, “we”) for using Giftnote Secret Santa at santa.giftnote.com. By using Secret Santa, you agree to them.
Secret Santa is free. Our privacy policy explains how we handle your information.
Who can use it
You need to be 16 or over to have an account. A child can take part in an exchange through a parent’s email address.
Your account
You sign in with a code or link we email you, or with Google or Shop. Anyone who can read your email can sign in as you, so keep your email to yourself.
Organising an exchange
When you add people to an exchange, we email them an invitation from you. Only add people you know and who would expect to hear from you, each with their own email address.
You choose the date, the budget and who sees what. Once anyone else joins, the date and time zone are locked, and you can still stop showing the pairs but not start. Once you do the draw, the date and time zone, who-sees-what, the rules for the draw and everyone’s email address are all locked. If you choose to show the pairs after the gift day: Nobody sees who drew whom until the day after gift day, when everyone finds out who had them and the organiser can see every pair. If not: Nobody, the organiser included, will ever see who drew whom. When three or fewer people are in the draw, everyone can work out the whole draw from who they’re buying for, whatever the organiser chooses. With four, what the reveal shows is enough to work it out. When the organiser’s rules leave few choices, who you’re buying for, or what the reveal shows, can be enough however many people are in it. In a group’s exchange, every owner and admin of the group can see what you see.
Using it fairly
- Don’t use Secret Santa to send spam, to harass anyone, or for anything unlawful.
- Keep gift-thread messages kind. You can mute a thread, or report it to us.
- Don’t do anything which is intended or reasonably likely to damage, impair, interrupt or interfere with Secret Santa, and don’t alter, modify, decompile, disassemble or reverse engineer it.
If an account misuses Secret Santa, we may stop it sending emails.
What you add
Wishlists, messages, names and notes you add stay yours. You let us store them and show them to the people they’re meant for, so Secret Santa can work. Only add what you have the right to share.
Gifts and shops
Gift ideas come from shops in Giftnote’s gift directory, or from the person who wants them. When you buy a gift, you buy it from the shop, on its own website and under its own terms: Giftnote isn’t the seller. Prices and stock are the shop’s and can change.
Our software
Secret Santa, its design and its code belong to Giftnote. We give you a revocable, non-exclusive, non-transferable and royalty-free right to use Secret Santa for your own exchanges.
Changes
Secret Santa is free, and we may change it or stop offering it. We may change these terms. The current version is always on this page, with the date it last changed at the top.
Your rights under Australian law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms takes away a right you have under it.
Law and courts
New South Wales law governs these terms. Each party irrevocably submits to the non-exclusive jurisdiction of the New South Wales courts.
